Summary
Drivers are prohibited from holding or operating a wireless telephone or electronic communication device unless it is used in a hands-free manner.
Rights & Rules
- 01.You may use a device if it is mounted on the dashboard or windshield in a way that does not block your view.
- 02.You are allowed to use a single swipe or tap to activate or deactivate a feature on a mounted device.
- 03.Emergency services calls are exempt from the hands-free requirement.
Penalties
- 01.A base fine of $20 for the first offense.
- 02.A base fine of $50 for subsequent offenses.
- 03.Additional court assessments can increase the total cost significantly.
- 04.Point on the driving record for second offenses within 36 months.
