California Security Deposit Limitation Act (AB 12)

Summary

Starting July 1, 2024, landlords in California are generally prohibited from charging more than one month's rent as a security deposit, regardless of whether the unit is furnished or unfurnished.

Rights & Rules

    Tenants cannot be forced to pay more than one month's rent upfront for a security deposit.
  • 02.
    Small landlords (owning no more than two properties) may still charge up to two months' rent in specific circumstances.
  • 03.
    Existing security deposits paid before the law's effective date are generally not affected.

Penalties

  • 01.
    Landlords may be liable for actual damages plus statutory damages of up to twice the amount of the security deposit.

    Court-ordered return of any overcharged funds.
