California Security Deposit Limitation Act (AB 12)
Summary
Starting July 1, 2024, landlords in California are generally prohibited from charging more than one month's rent as a security deposit, regardless of whether the unit is furnished or unfurnished.
Rights & Rules
- 01.Tenants cannot be forced to pay more than one month's rent upfront for a security deposit.
- 02.Small landlords (owning no more than two properties) may still charge up to two months' rent in specific circumstances.
- 03.Existing security deposits paid before the law's effective date are generally not affected.
Penalties
- 01.Landlords may be liable for actual damages plus statutory damages of up to twice the amount of the security deposit.
- 02.Court-ordered return of any overcharged funds.
