California Security Deposit Limitation (AB 12)
Summary
Starting July 1, 2024, landlords in California are generally prohibited from collecting a security deposit that exceeds the amount of one month's rent, regardless of whether the unit is furnished or unfurnished.
Rights & Rules
- 01.Tenants cannot be forced to pay more than one month's rent for a security deposit.
- 02.Small landlords (owning no more than two properties with no more than four total units) may still charge up to two months' rent.
- 03.Existing leases with higher deposits are generally not affected until a new lease is signed.
Penalties
- 01.Landlords may be liable for statutory damages up to twice the amount of the security deposit.
- 02.Requirement to refund the excess amount to the tenant immediately.
