Colorado Equal Pay for Equal Work Act
Summary
Colorado requires employers to disclose hourly/salary rates and benefits on all job postings and strictly prohibits paying employees of different sexes differently for substantially similar work.
Rights & Rules
- 01.Employers MUST include a salary range and a general description of benefits in every job posting.
- 02.Employers CANNOT ask about your previous salary history or use your past salary to determine what they will pay you.
- 03.You have the right to discuss your pay with your coworkers; employers cannot ban this or retaliate against you for doing so.
- 04.An employer cannot pay a man more than a woman for doing 'substantially similar' work, unless the difference is based entirely on a non-sex factor (like a strict seniority system or geographic location).
Penalties
- 01.Employees who are paid unfairly can sue for back pay for up to three years, plus 'liquidated damages' (double the back pay) and attorney's fees.
- 02.The state can fine employers up to $10,000 per violation for failing to post salary ranges.
