FDCPA: Validation of Debts

Summary

Within five days of first contact, a collector must send a written notice stating the amount of debt and the creditor's name.

Rights & Rules

  • 01.
    You have 30 days to dispute the debt in writing.
  • 02.
    You have the right to request the name and address of the original creditor.
  • 03.
    Collection must stop until the collector provides verification if you dispute it within 30 days.

Penalties

    Civil liability for non-compliance.

    Class action awards up to $500,000 or 1% of net worth.
