Summary

A person has no duty to retreat and has the right to stand their ground and use force, including deadly force, if they reasonably believe it is necessary to prevent death or great bodily harm.

    You do not have to run away or retreat before using force in a place you are legally allowed to be.

    You can use deadly force if you believe it is necessary to prevent a forcible felony.

    You may be immune from criminal prosecution and civil action if the force used was justified.

Penalties

    If the defense is rejected, the individual may be charged with Manslaughter (up to 15 years imprisonment).

    If the defense is rejected, the individual may be charged with Second-Degree Murder (up to life imprisonment).
