Florida 6-Week Abortion Ban

Summary

As of May 2024, Florida law strictly bans almost all abortions after six weeks of pregnancy (often before many women know they are pregnant).

Rights & Rules

  • 01.
    It is illegal for a physician to perform an abortion if the gestational age of the fetus is more than six weeks.
  • 02.
    There are exceptions if the abortion is necessary to save the pregnant woman's life or avert a serious risk of imminent substantial physical impairment.
  • 03.
    There is an exception for rape, incest, or human trafficking up to 15 weeks of pregnancy, BUT the woman must provide official documentation, such as a restraining order, police report, or medical record, to prove it.
  • 04.
    Medication abortions (abortion pills) must be dispensed in person by a physician; they cannot be mailed into the state.

Penalties

  • 01.
    Any person who actively participates in an illegal abortion (usually the doctor) commits a third-degree felony, punishable by up to 5 years in prison.
