In Florida, Homeowners Associations (HOAs) are legally capped on how much they can fine you. They generally cannot fine you more than $100 per day for a rule violation.

Rights & Rules

    Fines are capped at $100 per violation per day, with a total maximum of $1,000 for a single violation.
  • 02.
    The HOA MUST give you at least 14 days' written notice before they can levy a fine.
  • 03.
    You have the right to a hearing before a committee of other homeowners (not the board members) before a fine is finalized.
  • 04.
    An HOA CANNOT put a lien on your house for unpaid fines if the total is less than $1,000.

Penalties

    If your unpaid fines exceed $1,000, the HOA may be able to place a lien on your home.
  • 02.
    Unpaid regular assessments (dues) have no such cap and can lead to foreclosure much faster than fines.
