Illinois Legal Recreational Marijuana
Summary
Illinois legalized the recreational sale and use of marijuana in 2020. It was the first state to do so entirely through the state legislature rather than a voter ballot initiative.
Rights & Rules
- 01.Illinois residents aged 21 and older can legally purchase and possess up to 30 grams of cannabis flower, 500mg of THC in edibles, and 5 grams of cannabis concentrate.
- 02.Out-of-state visitors (non-residents) can only purchase and possess exactly HALF of those amounts.
- 03.You cannot smoke or consume marijuana in public places, inside a motor vehicle, or near anyone under the age of 21.
- 04.Unlike some other states, recreational users are NOT allowed to grow their own marijuana plants at home. Home cultivation is strictly reserved for registered medical marijuana patients (up to 5 plants).
Penalties
- 01.Growing marijuana plants without a medical card is a civil violation carrying a $200 fine (for up to 5 plants). Growing more than 5 is a felony.
- 02.Possessing more than the legal limits remains a criminal offense, ranging from a misdemeanor to a felony depending on the weight.
