Summary

Requires drivers to reduce speed and change lanes when approaching stopped emergency or maintenance vehicles with flashing lights.

Rights & Rules

  • 01.
    When approaching a stationary emergency vehicle (police, fire, ambulance), tow truck, or highway maintenance vehicle displaying flashing lights, drivers must proceed with due caution.
  • 02.
    Drivers must reduce their speed and, if safe to do so, change into a lane not immediately adjacent to the stationary vehicle.
  • 03.
    If a lane change is unsafe or impossible, drivers must reduce speed and proceed with caution.

Penalties

  • 01.
    First offense: Fine of $250.
  • 02.
    Subsequent offenses: Fine of $750.
  • 03.
    Violation results in a minimum fine of $250 and may result in a suspension of driving privileges.
  • 04.
    Fines double if the violation causes damage to another vehicle or injury/death to another person.

"(a) When approaching a stationary authorized emergency vehicle, when the authorized emergency vehicle is giving a signal by displaying alternately flashing red, red and white, blue, or red and blue lights, a person who drives an approaching vehicle shall: (1) yield the right-of-way and make a lane change into a lane not adjacent to the authorized emergency vehicle; (2) if a lane change is impossible, slow to a safe speed, while maintaining a safe speed for road conditions, and proceed with due caution."
