Massachusetts Right to Shelter Law

Summary

Massachusetts is the only state in the U.S. with a comprehensive 'Right to Shelter' law, legally requiring the state government to provide emergency housing to eligible homeless families and pregnant women.

Rights & Rules

  • 01.
    If you are a Massachusetts resident with dependent children (under 21), or if you are pregnant, and you meet the low-income requirements, the state MUST provide you with emergency shelter.

    The shelter provided must meet basic health and safety standards.
  • 03.
    You cannot be turned away simply because the state's existing shelters are full; the state is legally obligated to find a place for you (which historically led to the state placing families in motels and hotels).
  • 04.
    Note: In 2023, due to overwhelming demand, the Governor controversially instituted a 'cap' on the number of families the system would accept, resulting in waitlists and ongoing legal battles.

Penalties

  • 01.
    If the state denies shelter to an eligible family, legal aid organizations can immediately sue the state to force compliance and secure housing for the family.
