Michigan Reproductive Freedom (Proposal 3)

Summary

In 2022, Michigan voters overwhelmingly passed Proposal 3, which enshrined a fundamental right to reproductive freedom—including abortion and contraception—directly into the state constitution.

Rights & Rules

    Every individual has a fundamental constitutional right to make all decisions about pregnancy, including prenatal care, childbirth, postpartum care, contraception, sterilization, abortion, and miscarriage management.

    The state government cannot penalize or prosecute anyone for getting an abortion or helping someone get an abortion.
  • 03.
    The state CAN regulate abortion after the point of 'fetal viability' (usually around 24 weeks), but it CANNOT ban abortion if a doctor determines it is necessary to protect the physical or mental health of the pregnant individual.

Penalties

  • 01.
    Because this is a constitutional amendment, any state law attempting to ban abortion before viability is automatically void and unenforceable.
