Nevada 'Right to Return' Law (Hospitality)
Summary
Passed during the COVID-19 pandemic, this law guarantees that casino and hospitality workers who were laid off for economic reasons have the 'right to return' to their old jobs before the company hires someone new.
Rights & Rules
- 01.If you were laid off or furloughed from a casino, resort, or stadium due to the pandemic or a similar economic crisis, the employer MUST offer you your old job back when it becomes available.
- 02.The employer must notify you of the open position in writing (by mail and text/email).
- 03.If multiple former employees had the same job title, the employer must offer the job to the employee with the most seniority first.
- 04.You have 24 hours to accept or decline the offer.
Penalties
- 01.Employers who violate this law can be investigated by the Nevada Labor Commissioner, fined up to $500 per day per violation, and forced to pay back wages to the displaced worker.
