New Mexico law guarantees almost all private-sector employees the right to earn and use paid sick leave, regardless of whether they are full-time, part-time, or seasonal.

Rights & Rules

  • 01.
    You earn 1 hour of paid sick leave for every 30 hours you work.
  • 02.
    You have the right to use up to 64 hours of accrued sick leave per year.
  • 03.
    You can use this time to care for your own illness, injury, or doctor's appointment, or to care for a sick family member.
  • 04.
    You can also use 'safe leave' for absences related to domestic abuse, sexual assault, or stalking.

Penalties

  • 01.
    Employers who refuse to provide sick leave or who retaliate against employees for taking it can be sued for triple damages (treble damages) and attorney's fees.
