New York Clean Slate Act

Summary

Starting in late 2024, the Clean Slate Act automatically seals many criminal records in New York after a certain period of time, allowing formerly incarcerated people to get jobs and housing without discrimination.

Rights & Rules

  • 01.
    If you were convicted of a misdemeanor, your record will be automatically sealed 3 years after your release from jail (or from the date of conviction if you didn't go to jail).
  • 02.
    If you were convicted of an eligible felony, your record will be automatically sealed 8 years after your release.
  • 03.
    You MUST successfully complete probation/parole and not have any new criminal charges pending during the waiting period.
  • 04.
    Most serious violent felonies, sex offenses, and Class A felonies (like murder) are NOT eligible to be sealed under this law.

Penalties

  • 01.
    Once sealed, employers and landlords checking your background cannot see the convictions and cannot legally deny you housing or employment based on them.
