The 'Freelance Isn't Free' Act in New York
Summary
New York protects freelance workers and independent contractors by requiring written contracts for work over $800 and mandating that clients pay them on time.
Rights & Rules
- 01.If your freelance work is worth $800 or more (either a single project or combined over 120 days), the client MUST provide a written contract.
- 02.The client MUST pay you on or before the date stated in the contract.
- 03.If the contract does not list a payment date, the client MUST pay you no later than 30 days after you finish the work.
- 04.The client cannot force you to accept less money than agreed upon in exchange for getting paid faster.
Penalties
- 01.If the client refuses to pay, you can sue them for double the amount owed (double damages) plus attorney's fees.
- 02.Clients who consistently violate the act can be sued by the New York Attorney General for civil penalties.
