New York 'Freelance Isn't Free' Act

Summary

Originally a NYC law, this protection was expanded statewide to ensure freelancers and independent contractors receive written contracts and timely payments.

Rights & Rules

  • 01.
    If you are hired for freelance work totaling $800 or more in a 120-day period, the hiring party MUST give you a written contract.
  • 02.
    The contract must outline the exact pay rate and the specific date you will be paid.
  • 03.
    If the contract doesn't state a payment date, you MUST be paid within 30 days of completing the services.
  • 04.
    Clients cannot demand you accept less money in exchange for getting paid on time.

Penalties

  • 01.
    Freelancers can sue non-paying clients for double damages (twice the amount owed), statutory damages for failing to provide a contract, and attorney's fees.
