Paid Family Leave Rights in New York

Summary

New York workers have a right to up to 12 weeks of paid, job-protected leave to bond with a child or care for a sick family member.

Rights & Rules

  • 01.
    You can take up to 12 weeks of leave and receive 67% of your average weekly wage (capped at the state maximum).
  • 02.
    Your job is protected; your employer MUST give you your old job (or one very similar) back when you return.
  • 03.
    You can take this leave to bond with a newborn, adopted, or fostered child, or to care for a family member with a serious health condition.
  • 04.
    You are eligible if you have worked for your employer for 26 consecutive weeks (full-time) or 175 days (part-time).

Penalties

  • 01.
    If your employer refuses your leave or fires you for taking it, they are violating the law and can be sued for discrimination.
  • 02.
    You can continue your health insurance while on leave, but you must continue to pay your share of the premiums.
