Summary

New York provides one of the nation's most comprehensive paid family leave programs, giving workers up to 12 weeks of paid, job-protected time off for major family events.

Rights & Rules

  • 01.
    You can take up to 12 weeks of paid leave to bond with a newly born, adopted, or fostered child.
  • 02.
    You can take 12 weeks to care for a family member with a serious health condition.
  • 03.
    While on leave, you receive 67% of your average weekly wage, capped at a maximum state amount ($1,151/week in 2024).
  • 04.
    Your employer MUST hold your job for you and cannot retaliate against you. You also have the right to keep your health insurance while on leave.

Penalties

  • 01.
    Employers who refuse to provide the required leave or who fire an employee for taking it can be sued for discrimination, lost wages, and severe state fines.
