Summary
Employers in New York with 4 or more employees are legally required to include the minimum and maximum salary or hourly wage in any job advertisement.
Rights & Rules
- 01.Employers must post a 'good faith' salary range (e.g., $60,000 - $80,000) on all job postings, promotions, and transfer opportunities.
- 02.The law applies to fully remote jobs if the work can or will be performed by someone living in New York State.
- 03.The job posting must also include a description of the job (if one exists).
- 04.Employers cannot ask you about your salary history during the interview process.
Penalties
- 01.Companies can be fined by the NY Department of Labor for failing to post salary ranges.
- 02.Employees or applicants can file a complaint or civil lawsuit if they are denied this information or asked for salary history.
