Oregon HB 2001 (End of Single-Family Zoning)

Summary

To combat the housing crisis, Oregon became the first state in the nation to effectively ban exclusive 'single-family zoning' in its major cities.

Rights & Rules

    In cities with more than 10,000 people, the local city government CANNOT zone a neighborhood exclusively for detached, single-family homes.

    The city MUST allow property owners to build 'middle housing'—like duplexes—on any lot where a single-family home is allowed.
  • 03.
    In larger cities (over 25,000 people) and the Portland metro area, property owners must be allowed to build duplexes, triplexes, quadplexes, or 'cottage clusters.'
  • 04.
    HOAs (Homeowners Associations) established after this law passed cannot ban middle housing in their neighborhoods.

Penalties

  • 01.
    Cities that refuse to update their zoning codes to allow middle housing are forced to accept a 'Model Code' drafted by the state government, stripping the city of local control.
