Oregon Paid Sick Leave Law

Summary

Oregon requires all employers to provide sick leave. Whether it is paid or unpaid depends solely on the number of employees the company has and its location.

Rights & Rules

  • 01.
    You earn 1 hour of sick leave for every 30 hours worked, up to a maximum of 40 hours per year.
  • 02.
    If your employer has 10 or more employees (or 6 or more employees if located in Portland), the sick leave MUST be PAID at your regular wage.
  • 03.
    If your employer has fewer than 10 employees (or fewer than 6 in Portland), the sick leave is UNPAID, but you still have the right to take the time off without being fired.
  • 04.
    You can use sick leave for your own illness, a family member's illness, or for reasons related to domestic violence, sexual assault, or stalking (Safe Leave).

Penalties

  • 01.
    Employers who deny sick leave or retaliate against an employee for using it can be investigated by the Bureau of Labor and Industries (BOLI) and face fines and civil lawsuits.
