Pennsylvania 'Steer Clear' Law (Move Over Law)

Summary

Requires drivers to move over or slow down for any authorized emergency vehicle or disabled vehicle with flashing lights.

Rights & Rules

  • 01.
    When approaching an emergency response area (where emergency or maintenance vehicles are flashing lights or engaged in road work, or a disabled vehicle is present), drivers must move over to a lane further away if safe.
  • 02.
    If unable to move over, drivers must slow to at least 20 mph below the posted speed limit.

Penalties

  • 01.
    Two points on driving record.
  • 02.
    Fine of up to $500 for the first offense.
  • 03.
    Subsequent offenses: higher fines and potential license suspension.
  • 04.
    Fines are doubled if the violation leads to injury or death of an emergency service person or serious bodily injury to another person.

"(b) Duties of approaching driver. - When approaching an emergency response area, an approaching driver shall: (1) pass in a lane not adjacent to the emergency response area, if it is possible to do so safely; or (2) if passing in a nonadjacent lane is impossible, reduce the driver's speed to a reasonable and prudent speed, which shall be less than the posted speed limit and appropriate for the road conditions, but in no case greater than 20 miles per hour less than the posted speed limit."
