South Carolina Heritage Act

Summary

The Heritage Act makes it extremely difficult to remove, rename, or alter historical monuments, statues, and street names located on public property in South Carolina.

Rights & Rules

  • 01.
    No war monument or memorial on public property (including schools and city property) can be relocated, removed, or altered.
  • 02.
    No street, bridge, park, or public area dedicated to a historical figure or event can be renamed.
  • 03.
    The ONLY way to change or remove these memorials is if the South Carolina General Assembly passes a bill with a massive two-thirds (2/3) supermajority vote in both the House and the Senate.

Penalties

  • 01.
    While there are no direct civilian penalties, local governments or universities that attempt to remove monuments without state approval violate state law and their actions are considered legally void.
