Texas E-Verify Law (SB 3)

Summary

Texas law requires all state agencies, public universities, and private businesses that receive government contracts to use the federal E-Verify system to check the immigration status of all new employees.

Rights & Rules

01.
If you are hired by the State of Texas or by a company doing business with the State of Texas, they MUST run your information through the federal E-Verify database.
02.
E-Verify checks your Social Security Number or Alien Registration Number against federal records to ensure you are legally authorized to work in the US.
03.
Private businesses that do NOT have state contracts are not required by state law to use E-Verify, though they must still complete standard federal I-9 forms.

Penalties

01.
Contractors who fail to use E-Verify can have their state contracts immediately terminated and can be barred from bidding on future state contracts.
