Texas Near-Total Abortion Ban (Trigger Law)

Summary

Following the overturn of Roe v. Wade, Texas enacted a 'trigger law' that makes performing an abortion a severe felony at any stage of pregnancy, with virtually no exceptions.

Rights & Rules

    It is a first-degree felony to perform, induce, or attempt to perform an abortion at any stage of pregnancy in Texas.

    There are NO legal exceptions for pregnancies resulting from rape or incest.

    The ONLY exception is if the pregnancy places the mother in danger of death or a 'serious risk of substantial impairment of a major bodily function.'

    The pregnant woman herself cannot be prosecuted or sued under this law; the penalties target the doctor or person providing the abortion.

Penalties

    Doctors who perform an abortion face 5 to 99 years (or life) in prison, a mandatory fine of at least $100,000, and the automatic revocation of their medical license.
