Summary

Regulates the expiration dates and fees associated with gift certificates and gift cards in Florida.

Rights & Rules

  • 01.
    You have the right for your gift certificate or gift card to be valid for at least 5 years from its issuance date or the last date funds were added.
  • 02.
    You have the right not to be charged dormancy fees or service charges within the first year of inactivity.
  • 03.
    You have the right to clear disclosure of all terms and conditions of a gift certificate.

Penalties

  • 01.
    Violation of this Act is considered an unfair or deceptive trade practice under FDUTPA.
  • 02.
    Enforcement by the Department of Agriculture and Consumer Services.
