Summary

Prohibits unfair methods of competition and unfair or deceptive acts or practices, including fraud, false pretenses, or misrepresentation, in any trade or commerce.

Rights & Rules

    You have the right to be free from fraud, misrepresentation, or deceptive practices in business transactions.
  • 02.
    You can sue for damages if you suffer actual injury from such practices.
  • 03.
    You can seek injunctive relief to stop deceptive business practices.

Penalties

  • 01.
    Actual damages sustained by the consumer.
  • 02.
    In some cases, punitive damages.
  • 03.
    Attorney's fees and court costs.
  • 04.
    Civil penalties up to $50,000 (and $10,000 for each violation after notice) for actions brought by the Attorney General.

"Unfair methods of competition and unfair or deceptive acts or practices, including but not limited to the use or employment of any deception, fraud, false pretense, false promise, misrepresentation or the concealment, suppression or omission of any material fact, with intent that others rely upon the concealment, suppression or omission of such material fact, or the use or employment of any practice described in Section 2 of the 'Uniform Deceptive Trade Practices Act', approved August 5, 1965, in the conduct of any trade or commerce are hereby declared unlawful whether or not any person has in fact been misled, deceived or damaged thereby."
