Prohibits deceptive acts or practices in the conduct of any business, trade, or commerce in New York State.

Penalties

  • 01.
    Civil penalties up to $5,000 for each violation, payable to the State.
  • 02.
    Consumers can recover actual damages or $50, whichever is greater (treble damages up to $1,000 if the deceptive act was willful).
  • 03.
    Consumers can recover attorney's fees.
